First – The purpose of the terms and conditions
By accessing this website and/or booking with us, we agree that you accept these terms and conditions in full. Do not continue to use the Free Walking Tours Bordeaux – website if you do not accept all of the terms and conditions stated on this page.
The following terminology applies to all Terms and Conditions, Privacy Statements, Disclaimer Notices and any or all terms and conditions: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the company’s terms and conditions fully. “The Company”, “Operator”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. “Travel agency”, “Tour operator” or “ Facilitator” refers to our partners and providers we work with.
All these terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of France. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to the same.
The purpose of these terms and conditions is to standardise the conditions between our Clients, our company (aka Free Walking Tours Bordeaux) and facilitators. The General Conditions in this are the framework and successive annexes may be added to it, to become part of the terms and conditions, including the specific conditions of each tour activity, excursion, walking and wine tours, accommodation, restaurant and/or transfer organised as well as the relevant specifications and validation of the prices according the services chosen by you.
Second – Payment conditions and cancellation fees
For our Free Walking Tour offers the payment is done on voluntary bases at the end of each tour. Our prices are given net and in euros €.
For our paid tours our Company requires full payment before the beginning of the tour, if not the client cannot participate. In special cases we can invoice the tour activity taken by the client also after the tour took place, this has to be agreed on in advance of the tour and with an official bill from us.
Free Walking Tours Bordeaux requires full payment by credit card, internet payment like paypal (through our website) or wire transfer to make a reservation. Wire transfer fees are entirely at the charge of the client and can be invoiced by us at any time. We accept payment by AMEX, Visa and Mastercard. There is no charge or service fee for processing credit card payments except with American Express +3%. Payments can only be done in Euros.
Additional costs for cancellations, changes or extra facilities will be charged accordingly.
Third – Cancellation by the client
Free Walking Tours Bordeaux strictly adheres to its cancellation policy and will make no exceptions to the policy. If the client chooses to cancel his or her reservation, Free Walking Tours Bordeaux must receive written notice from the Client, Travel agency or Tour operator about the cancellation via email sent to contact@freewalkingtours.com or sent through our online booking system on our website. The Client, travel agency or tour operator will receive a cancellation confirmation from Free Walking Tours Bordeaux.
The cancellation of a service due to bad weather, is the sole decision of the customer. No refund can be claimed.Professional civil liability insurance
Every Client, Travel Agent and Tour Operator is subject to the following cancellation fee schedule:
Free Tour – Cancellation is always possible.
Paid Tours – Cancellation has to be done before the tour starts, the cancellation possibilities can vary on every tour, the final and applicable cancellation policy is mentioned under “Schedule” on our website for every tour description.
Additional costs for cancellations, changes or extra facilities will be charged on our client accordingly.
Four – Cancellation by Free Walking Tours Bordeaux
We have the whole right to cancel all reservations. Only if Free Walking Tours cancels the reservation, full refund will be granted but with no legal extra compensation.
No insurance for cancellation or assistance is included in the prices mentioned for all our tours. Free Walking Tours Bordeaux is not obliged to give any explanation for the cancellation of any tours to the clients.
An email will be sent to the client at any time before or after the tour about the cancellation with information about the refunding.
Fifth – Visit and Schedules
The tours, visits and services are made by reservation, so the finalised itinerary will depend on the partners availability and can change at the last minute.
Sixth – Limitative Clause
Free Walking Tours Bordeaux or any facilitator will not be responsible for any cancellation due to any conditions out of our control (ex. natural disasters, strike, terrorist attack or road intervention). No refund will be granted in case of any conditions as mentioned above.
Free Walking Tours Bordeaux cannot be held liable in the event of loss, forgetfulness, theft or damage to personal effects during the services it organises on behalf of its customers, whether in the premises used for the occasion, means of transport, accommodation, places to eat, etc.
Seventh – Services
During the visit any kind of illegal actions like abusing drugs, threat to the driver or staff, or impoliteness by the client can cause the services to stop immediately. The participation of children on our tours are limited, check the tour description.
Children under 12 years old must be accompanied by a responsible adult. Minors under 18 will never get alcohol on our tours. .
Eight – Insurance
The responsibility of Free Walking Tours Bordeaux is limited to our insurance contract clauses of our Professional civil liability insurance
Ninth – French transportation rules
We respect the French transportation rules and terms of driving and schedules. Any demand of increasing speed will be denied by the driver to exceed the authorised speed limit or to commit breaches of any highway code rule. Eating, drinking and smoking in the car are strictly forbidden (law of September 17th, 1977).
Tenth – Confidentiality
All information, either data, databases, procedures or documents that both parties share in any format or medium will be treated by us with absolute confidentiality and will not send, assign them to any other party or use them for any other purposes. The confidentiality clause will remain in force indefinitely after the service or tour is terminated.
Data is collected and processed for the purpose of managing your stay (including booking, monitoring, payment, satisfaction assessment, information). For use for commercial prospecting purposes, we ask for your consent in accordance with the rules of the GDPR. In accordance with the provisions of the “IT and freedom” law of 6 January 1978, you have the right to access your data, the right to modification and the right to objection, which you can exercise either by contacting us by e-mail at contact@freewalkingtoursbordeauxFR.com, or by writing a letter indicating your name, first name and postal address.
Eleventh – Applicable Law and Jurisdiction
These terms and conditions are governed and construed in accordance with the French legislation. To resolve all controversies that may arise from the interpretation, execution and resolution, both Parties submit to the jurisdiction of the Courts of the city of Bordeaux, expressly waiving any other jurisdiction that may correspond to them. In accordance to all the foregoing and with the will to be bound.
Twelfth – Our Promotional Materials
Photographs and videos taken by us or our partners during a tour are the property of Free Walking Tours Bordeaux, and may be used in promotional materials. Feedback, both verbal and/or written, provided by Clients about a Tour is also our property, and may be used in promotional materials, including our website and social media.
